Insane Boxing Academy

- Acknowledgment of Risk
By signing this document and/or participating in any activity at Insane Boxing Academy, the participant (hereinafter referred to as “the Member”) acknowledges and understands that:
1.1. Boxing and fitness training are physically demanding and inherently dangerous activities that involve significant risk of injury, including but not limited to physical trauma, sprains, fractures, or death.
1.2. The Member voluntarily engages in training and activities at their own risk and confirms they are physically fit and capable of participating.
1.3. It is the Member’s responsibility to seek medical clearance prior to beginning any training or fitness programme, especially if they have pre-existing health conditions.
- Assumption of Liability
2.1. The Member fully accepts all risks, dangers, and responsibilities arising from participation in any activity offered by Insane Boxing Academy, including risks arising from the negligence of the facility, its staff, or third parties.
2.2. The Member agrees that Insane Boxing Academy, Head Coach Gugushe ‘Gucci’ Lwandile, instructors, staff, agents, volunteers, and affiliates shall not be held liable for any loss, injury, damage, or death suffered by the Member during training, on or off the premises, or during any event or competition linked to the Academy.
- Indemnity
3.1. The Member hereby irrevocably indemnifies, releases, and holds harmless Insane Boxing Academy and its representatives against any claims, demands, actions, damages, or legal costs which may arise from:
- Participation in training sessions;
- Use of equipment or facilities;
- Attendance at events, sparring sessions, or competitions;
- Acts or omissions by other members or third parties.
3.2. This indemnity is binding on the Member’s heirs, executors, dependants, and assigns.
- Rules and Conduct
4.1. Members must comply with all rules, safety guidelines, and instructions issued by the Academy and its staff.
4.2. Failure to follow rules or staff directions may result in immediate suspension or termination of membership without refund.
4.3. Members agree to behave respectfully and responsibly towards coaches, staff, and fellow members at all times.
- Medical Emergencies
5.1. In the event of a medical emergency, the Academy reserves the right to arrange emergency medical treatment for the Member, at the Member’s cost.
5.2. The Academy does not provide personal accident or medical insurance. Members are encouraged to obtain appropriate personal medical or accident insurance coverage.
- Minors (Under 18 Years of Age)
6.1. Where the Member is under the age of 18, this indemnity must be signed by a parent or legal guardian, who accepts full responsibility for the minor’s participation and safety.
6.2. The guardian also indemnifies the Academy and its representatives on behalf of the minor.
- Photography and Media
7.1. Members consent to the Academy taking photos and videos during training and events, which may be used for marketing or promotional purposes, unless explicitly objected to in writing.
- Waiver and Severability
8.1. No relaxation or indulgence by the Academy shall constitute a waiver of any rights under these terms.
8.2. If any clause is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
- Jurisdiction
9.1. This agreement shall be governed by the laws of the Republic of South Africa, and any dispute shall be subject to the exclusive jurisdiction of the courts of South Africa.
- Declaration
I, the undersigned, hereby declare that:
- I have read and understood the above terms and conditions;
- I accept full responsibility for my participation;
- I indemnify and hold harmless Insane Boxing Academy and its staff from any claim arising from my participation.
